TERMS AND CONDITIONS OF USE

1. General provisions
These sale and purchase rules (hereinafter – “Rules”) are a legally binding document setting out mutual rights, obligations and responsibility of the Buyer (hereinafter – the “Buyer”) and the Seller (hereinafter – the “Seller”) when purchasing items from the online store youandoil.lt.

2. The moment of conclusion of sale and purchase contract
2.1. The contract between the Buyer and the Seller is considered concluded from the moment, when the Buyer, having formed the bag of goods and specified the delivery address, having selected the method of payment and familiarized with our rules in the online store, presses the button “Confirm the Order”.


2.2. Each contract made between the Seller and the Buyer shall be stored in the online store.

3. Rights of the Seller
3.1. The Seller, in case of significant circumstances, may temporarily suspend or permanently stop the online store activities without any prior notice to the Buyer. 


3.2. If the Buyer tries to adversely affect the online store operation or stable functioning, the Seller may without any prior notice to restrict or suspend the Buyer’s access to the online store or, in exceptional cases, to withdraw the Buyer’s registration. 


3.3. The Seller reserves the right to unilaterally amend the terms and conditions of these rules without any prior notice. 


3.4. The Seller is entitled to cancel the Buyer’s order without any prior notice, if the Buyer fails to pay for the goods within 3 (three) business days. 


3.5. The Seller is not responsible for any cases, when the goods available in the online store may not in their colour, form or other parameters due to characteristics of the display used by the Buyer.
 
4. Obligations of the Seller
4.1. The Seller is obliged to provide the Buyer with all the conditions for proper use of services delivered by the online store.


4.2. The Seller is obliged to deliver goods ordered by the Buyer to the address specified by the Buyer within the agreed delivery time. 


4.3. The Seller, in the event of significant circumstances, being unable to deliver goods ordered to the Buyer, undertakes to offer equivalent goods to the Buyer, and if the Buyer refuses to accept equivalent goods, make a refund of paid money within 72 hours, if the Buyer has made an advance payment.
 
5. Obligations of the Buyer
5.1.The Buyer, when using the online store, agrees with these sale and purchase rules and undertakes to observe them. 


5.2. The Buyer is obliged to accept goods ordered and pay the agreed amount of money for them. 


5.3. In the event of change of data supplied in the Buyer’s registration form, the Buyer is obliged to immediately update them. 


5.4. If the Buyer, at the time of delivery of goods, refuses to accept goods without urgent cause, the Buyer is obliged to pay the costs of goods delivery.
 
6. Delivery of goods
6.1. Goods shall be delivered by the Seller or authorised representative of the Seller.

6.2. At the time of delivery of goods, the Buyer must verify the condition of consignment together with the Seller or authorised representative of the Seller.


6.3. The consignment is considered to be transferred, when the Buyer signs the transfer document presented by the courier.


6.4. In the event of detection of any consignment damages, the Buyer is entitled not to accept the consignment and make a note of it in a consignment note. The consignment is considered to be accurately transferred, when the Buyer accepts goods and signs the consignment note without any remarks.


6.5. The Buyer shall be informed by telephone about the accurate delivery time of goods. If it is impossible to contact the Buyer by telephone, the goods shall be inevitably delivered to the specified address.


6.6. No delivery services are available on weekend and bank holidays. Furthermore, we do not deliver to Kuršių Nerija.


6.7. At the time of delivery of goods, the Buyer together with the authorised representative of gamtosreceptai.lt – courier has to check the condition of consignment and sign the invoice, consignment note or other document of goods transfer and acceptance. After signature, it is considered that the Buyer is satisfied with the condition of consignment. If the Buyer is not satisfied with the condition of the consignment, the Buyer is required to draw up a free-format statement of consignment damage and produce it to the courier representative who has delivered goods. 


6.8. Goods are shipped to the Buyer immediately upon receipt of order payment (or on the following business day). Goods are usually delivered to the Buyer within 2 or 3 business days after their shipment.
 
7. Return of items
7.1. Items may be returned in accordance with the Order of the Minister of Economy of the Republic of Lithuania on Sales of Items and Delivery of Services where Contracts Are Concluded by Using the Means of Communication dated 17 August 2001.


7.2. In the event of delivery of defective goods, the Seller shall undertake to replace faulty goods within the shortest possible time. If it is impossible to replace faulty goods, the Seller gives a refund to the Buyer or replaces goods by equivalent items.


7.3. On Buyer’s request, qualitative goods may be replaced or returned by a separate agreement. In such a case, transport costs shall be paid by the Buyer.


7.4. The Buyer is entitled to change or return qualitative goods which may be changed or returned without giving any reason within 7 days from their delivery date. In such a case, transport costs shall be paid by the Customer. The returning goods must be free from damage, in the original packaging and otherwise correspond to the condition at the time of purchase.


8. Responsibility
8.1. The Buyer has full responsibility for accuracy of data supplied in the registration form. If the Buyer does not supply accurate data in the registration form, the Seller does not assume any responsibility for any consequences resulting from it. 


8.2. The Buyer is responsible for actions performed by using the online store youandoil.lt.


8.3. The Buyer assumes responsibility for disclosure of access data to third parties. Where third parties use access data of the Buyer, the Buyer assumes responsibility for any actions performed by third parties. 


8.4. The Seller is not responsible for the information given on websites of other companies, even if the Buyer accesses these websites via links available on the Seller’s online store website. 


8.5. In the event of damage, the guilty party compensates the other party for any losses incurred.
